The transfer of a farm is an unusual property transfer and different concerns arise as it is often the transfer of not only a piece of property but the family business and an asset intrinsic to the heart of the family.We offer a practical and pragmatic overview of such transactions and encourage parties to consider the effect of the transfer far beyond its actual date, to ensure that all concerns are met and that there is a plan for the future.
There is a focus in Ireland on Farming 2020 and grants and schemes available to assist younger farmers taking over land from the previous generation. However, there are also responsibilities in taking over the land and the transferee should also be fully advised as to their responsibility in taking over the property and understand the obligations that may be placed on them by way of rights of residence, annuities, maintenance and support, farm insurance and their ability to deal effectively with the property while their parents or relatives still have an interest in same.
